IN 2016 AND 2017 WLADIMIR SENUTOVITCH donated 444 square feet of land to the condominium. Because this land was a narrow sliver sandwiched between the arroyo and the condo, it was worthless to him.

All this land was assigned to unit 2.

The grant was negotiated by Robert Deacon, owner of unit 2 and president of the condominium. He planned to move the west fence of the condo outward to enlarge unit 2’s yard. However, after the grant was finalized and the new survey finished, Deacon discovered that the fence could not be legally moved outward because Santa Fe law forbids construction of a fence within a certain distance of an arroyo. The money spent to accept the grant (lawyer’s and surveyor’s fees) had been wasted.

Nowadays, as a result of Deacon’s efforts and expenditures, a strip of land on the far side of the west fence belongs to the condo, but the condo can’t do anything with it and for practical purposes it might as well belong to the city.
